Terms of Service
1. Acceptance of Terms
By accessing or using the GeoPin website, API or related services (collectively the "Service"), you agree to these Terms of Service ("Terms"). If you use the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, and "you" refers to that organisation.
If you do not agree to these Terms, you may not access or use the Service. Your continued use of the Service after any changes to these Terms constitutes acceptance of those changes.
2. Definitions
- "GeoPin," "we," "us," "our" — refers to GeoPin, operated from the Netherlands.
- "Service" — the GeoPin geolocation API, website, documentation and all related tools and features.
- "User," "you," "your" — any natural or legal person who accesses or uses the Service.
- "API Key" — a unique authentication credential issued to you for accessing the GeoPin API.
- "Request" or "API Call" — a single geolocation inference submitted via the API.
- "Plan" — the subscription tier you have selected (Free, Pro or Enterprise), each with associated usage limits and features.
3. Service Description
GeoPin provides a geolocation inference service for the Netherlands. Users submit images via our API, and our machine learning models return estimated geographic coordinates and location metadata. The Service is provided "as is" and results are probabilistic estimates, not verified facts.
GeoPin is designed and optimised for geolocation within the Netherlands. Results for images depicting locations outside the Netherlands may be significantly less accurate or unavailable.
4. Accounts & API Keys
4.1 Account Registration
To access the Service beyond the free trial, you must create an account by providing a valid email address. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.
4.2 API Key Security
Your API key is a secret credential. You must:
- Keep your API key confidential and not share it with unauthorised third parties.
- Not embed API keys in client-side code, public repositories or other publicly accessible locations.
- Notify us immediately via info@geopin.nl if you suspect your API key has been compromised.
We reserve the right to revoke and reissue API keys at any time if we detect or suspect unauthorised use.
4.3 Account Information Accuracy
You agree to provide accurate, current and complete information during registration and to keep your account information up to date. Accounts registered with inaccurate or misleading information may be suspended or terminated without prior notice.
5. Plans & Usage Limits
The Service is offered under the following subscription tiers. Specific request limits, features and pricing are as published on our Pricing page at the time of your subscription:
5.1 Free Tier
- Available with a free account (registration required).
- Subject to daily and monthly request limits as published on our Pricing page.
- Free accounts are limited to 3 searches per month.
- Access to the free tier may be throttled more aggressively during periods of high demand.
5.2 Pro Plan
- Requires a registered account and an active paid subscription.
- Higher request limits, priority processing and access to advanced API features as described on our Pricing page.
- Billed monthly or annually in advance.
5.3 Enterprise Plan
- Custom request limits, dedicated support, SLA and a Data Processing Agreement.

5.4 Overage
If you exceed the request limit of your plan, additional requests will be rejected with an HTTP 429 status code until your limit resets or you upgrade your plan. We do not charge overage fees without prior agreement.
6. Fair Use Policy
All plans are subject to fair use. Fair use means using the Service in a manner consistent with its intended purpose — submitting images for geolocation inference. The following activities are considered outside fair use:
- Automated bulk requests that significantly exceed your plan's stated limits through circumvention techniques (e.g. rotating API keys, creating multiple free accounts).
- Using the Service as a component of a data pipeline where requests are generated without meaningful human review of results.
- Systematically scraping or harvesting GeoPin's infrastructure, model output or response data to build a competing service.
- Sharing a single API key across multiple unrelated organisations or applications without permission.
We reserve the right to contact you if your usage pattern appears inconsistent with fair use and, if necessary, to restrict or suspend access. We will make reasonable efforts to notify you before taking action.
7. API Abuse Policy
The following activities constitute API abuse and may result in immediate suspension or termination of your account without refund:
- Attempts to circumvent authentication, rate limiting or other security measures.
- Sending requests designed to overload, disrupt or probe vulnerabilities in our infrastructure (including denial-of-service attacks, fuzzing or injection attacks).
- Reverse-engineering, decompiling or otherwise attempting to extract the underlying models, algorithms or source code of the Service.
- Submitting content that violates our Acceptable Use Policy, including but not limited to images related to stalking, harassment or illegal surveillance.
- Circumventing free-tier limits by creating multiple accounts, rotating IP addresses or other evasion techniques.
We monitor API usage patterns to detect abuse. Upon detection of abuse, we may at our sole discretion take one or more of the following actions:
- Issue a warning requesting that you cease the offending behaviour.
- Temporarily restrict or suspend API access.
- Permanently revoke your API key(s) and terminate your account.
- Report illegal activities to the competent Dutch or European authorities.
8. Payment Terms
8.1 Pricing
All prices are listed in euros (EUR) and are exclusive of VAT unless otherwise stated. VAT is added at the applicable Dutch/EU rate. Business customers with a valid EU VAT number (outside the Netherlands) may be eligible for the reverse charge mechanism.
8.2 Billing Period
Paid subscriptions are billed in advance on a monthly or annual basis, depending on your chosen billing cycle. Your subscription renews automatically at the end of each billing period unless cancelled.
8.3 Payment Methods
We accept payment via SEPA direct debit, bank transfer and other payment methods we may make available from time to time. By providing a SEPA direct debit mandate, you authorise GeoPin to collect payments from your bank account on the dates specified on your invoice.
8.4 Late Payment
If payment is not received within 14 days of the invoice date, we may suspend your access to the Service until payment is received. We reserve the right to charge statutory interest on overdue amounts in accordance with Dutch law (Commercial Interest Act).
8.5 Refunds
Please refer to our Refund Policy for information on cancellation and refunds.
9. Accuracy Disclaimer
GeoPin's geolocation results are generated by machine learning models and are probabilistic estimates. You acknowledge and agree that:
- Results may be inaccurate, incomplete or incorrect. Accuracy varies depending on image quality, content, environmental factors and model limitations.
- Results should not be used as the sole basis for decisions with legal, financial, safety or other significant consequences.
- Results do not constitute legal evidence and should not be presented as such without independent verification by qualified professionals.
- We make no warranty or representation regarding the accuracy, reliability or completeness of any geolocation result.

10. Intellectual Property
10.1 Our Intellectual Property
The Service, including the software, models, algorithms, API design, documentation, website content and visual design, is the intellectual property of GeoPin and is protected by Dutch and international copyright and intellectual property law. You may not copy, modify, distribute or create derivative works of any part of the Service, except as expressly permitted by these Terms or applicable law.
10.2 Your Content
You retain all rights to images and other content you submit to the Service. By submitting content, you grant GeoPin a limited, non-exclusive, non-transferable licence to process that content solely for the purpose of delivering the Service to you. This licence terminates immediately upon completion of the geolocation inference for each submitted image.
10.3 API Output
Geolocation results returned by the API are made available to you. You may use, store and display results in your own applications. However, you may not resell raw API output as a standalone data product or use it to build a directly competing geolocation service.
11. Limitation of Liability
To the maximum extent permitted by Dutch law:
- The Service is provided "as is" and "as available" without any warranty, whether express, implied or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement.
- GeoPin shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profit, data, business or goodwill, arising out of or in connection with your use of the Service.
- GeoPin's total aggregate liability for all claims arising out of or in connection with the Service shall not exceed the amount you have paid to GeoPin in the twelve (12) months preceding the event giving rise to the claim, or one hundred euros (EUR 100), whichever is greater.
- Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot be excluded under Dutch law.
12. Indemnification
You agree to indemnify, defend and hold harmless GeoPin, its officers, employees and agents against all claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Service in violation of these Terms or applicable law.
- Your breach of the Acceptable Use Policy.
- Content you submit to the Service that infringes the rights of third parties.
- Your use of geolocation results in a manner that causes harm to third parties.
13. Termination
13.1 Termination by You
You may cancel your subscription at any time and close your account by contacting us at info@geopin.nl. Cancellation takes effect at the end of your current billing period. Please refer to our Refund Policy for information on refunds upon cancellation.
13.2 Termination by GeoPin
We may suspend or terminate your account immediately and without prior notice if:
- You breach these Terms, the Acceptable Use Policy or any other applicable policy.
- We are required to do so by law or a competent authority.
- Your account has been inactive for more than 12 consecutive months (free tier only).
- We reasonably believe your use of the Service poses a security risk or could cause harm to other users or third parties.
13.3 Effects of Termination
Upon termination, your API keys will be revoked and you will lose access to the Service. We retain your data only as described in our Privacy Policy. Sections of these Terms that by their nature survive termination (including Limitation of Liability, Indemnification and Governing Law) shall continue to apply.
14. Modifications to the Service
We reserve the right to modify, suspend or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to provide advance notice of material changes. We shall not be liable to you or any third party for any modification, suspension or discontinuance of the Service.
15. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.
Disputes arising out of or in connection with these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent court in the Netherlands. If you are a consumer within the EU, this provision does not affect your right to bring proceedings before the court of your Member State of residence under Regulation (EU) No 1215/2012.
Before initiating legal proceedings, both parties agree to attempt to resolve disputes amicably by negotiating in good faith for a period of at least 30 days.
16. Severability
If any provision of these Terms is found by a competent court to be invalid, unlawful or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
